There are multiple reasons why people may claim for compensation. One of the biggest incentives for filing for compensation is the safety of mind that the incident will not affect anyone else. Often courts demand that the factors involved in any incident, usually when involved in a work place accident or accident occurring upon public property, are fixed to ensure no one else suffers from the trauma.
There are of course other benefits for compensation claims. Those who file successfully for compensation usually have suffered some kind of monetary loss, and so are usually granted a sum to cover the loss.
Whether it’s from loss of earnings, expensive medical bills, or for pain and suffering caused by the incident, monetary compensation cannot take back the anguish caused by the event but can go some way to cover the costs.
Out of Work
Employers are obliged to pay statuary sick pay, and you must ensure you claim for this. However, statuary sick pay may not cover the amount of time you are away from work; and for those who work overtime or on commission, this will not cover the losses they are making due to their absence from the workplace.
One business man filed for commission based upon this, and as was reported in a First4Lawyers medical solicitor blog, was granted £2.43million by the High Court. Mr Bright, a customer services and contracts manager, lost the use of his left arm and suffered brain damage after being involved in a shunt on the motorway.
Mr Bright felt fine after the accident, but later discovered the whiplash experienced resulted in a blood clot which caused a stroke. This injury left him unable to work anymore, and his compensation covers not only the lifetime rehabilitation and care needed, but also for loss of earnings.
It’s Your Right
The law enables you to file for compensation following an incident, so there is no reason not to claim. With the right help, anyone is able to file for compensation and receive the money they are owed and deserve.
One contracting company received compensation from Sunderland Eye Infirmary after failing to be warned of the presence of asbestos in the walls they were working on.
The Health and Safety Executive investigated the situation and found that the City Hospitals Sunderland NHS Foundation Trust was aware of the presence of asbestos but failed to inform the contractors, putting them at risk of exposure and illness.
The Trust were fined £3,000 and ordered to pay an additional £4,582.40 in costs.
Times are Hard
While money is still tight for everyone, now is the time to file for compensation. The money that could be won may be able to ease the difficult financial situations we all find ourselves within, and if you have suffered, it is within your right to make a claim.
The Financial Ombudsman ensures measures are set in place for people to receive compensation for any “distress” (including embarrassment, anxiety, disappointment and loss of expectation), “inconvenience”, and “pain and suffering”. These measurements ensure you are always covered by an impartial assessment who can confirm your right to compensation.
